Privacy Policy and the Rules for the Use of Cookies
1. GENERAL PROVISIONS
1. This document sets out the principles for the processing of personal data obtained from customers by the Skórnik-Styl Online Store operated at www.skornikstyl.pl by Jadwiga Zyza. It also contains information regarding the use of cookies and analytical tools in the Online Store.
2. The controller of personal data is Jadwiga Zyza, conducting sole proprietorship under the name “Skórnik-Styl”, registered in the Central Register and Information on Economic Activity, NIP: 9461139060, REGON: 431214115.
3. Personal data collected by Skórnik-Styl via the Online Store are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data (General Data Protection Regulation, hereinafter “GDPR”).
4. The Skórnik-Styl store informs that personal data of customers will be processed solely for the purpose of executing and fulfilling the contract concluded with the Buyer/Customer. With additional consent, the data may also be processed for the purpose of sending information materials or marketing offers in the form of a Newsletter.
5. The Skórnik-Styl Online Store makes every effort to respect your privacy and ensure the protection of the personal data provided when using and making purchases within the store. For this purpose, a secure SSL communication encryption protocol is used.
6. Providing personal data is voluntary; however, failure to provide data marked as necessary makes it impossible to register or place an order.
2. TYPE, PURPOSES AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA
In the Skórnik-Styl Online Store, personal data are collected in the following cases:
- 1) To perform the contract for the sale of goods from the Store related to the registration of an Account and placing Orders — the legal basis is Article 6(1)(b) of the GDPR (performance of a contract).
- 2) To establish, pursue, or enforce claims — the legal basis is Article 6(1)(f) of the GDPR (legitimate interest of the controller).
- a) In these cases, the necessary scope of data processed includes: first and last name; email address; contact telephone number; address: street, house number, apartment number, postal code, city, country; residential/business address; bank account number (in case of refunds); and, for non-consumer customers, additionally company name and tax identification number (NIP), as well as other data collected while using the Online Store.
- 3) Subscribing to the newsletter (Newsletter) in order to perform the contract, the subject of which is an electronic service. Legal basis — consent of the Customer to perform the contract for the provision of the Newsletter service (Article 6(1)(a) GDPR).
- b) In this case, the necessary scope of processed data includes email address and contact phone number.
3. SHARING OF PERSONAL DATA
1. For the proper functioning of the Online Store, it is necessary for the Administrator to use the services of external entities. The Administrator ensures that data processors comply with all legal requirements, including the GDPR.
2. The Administrator provides data only when it is necessary to achieve the purpose of processing and only to the extent required.
3. Customers’ personal data may be transferred to the following entities:
- a) Providers of hosting and IT services,
- b) Carriers responsible for order shipments (as listed in the Online Store Regulations),
- c) Entities handling electronic payments in the Online Store,
- d) Entities providing accounting, legal, and advisory services.
4. PERIOD OF STORAGE OF PERSONAL DATA
1. The provided personal data will be processed for the period:
- a. Necessary for the implementation of the concluded contract for the sale of goods, including handling customer complaints and the pursuit or defense of claims by the Administrator — but no longer than 10 years from the date of data provision.
5. PROFILING
1. The Skórnik-Styl Online Store may use profiling functions that involve automated processing of personal data allowing for the assessment of certain personal factors of an individual, in particular to analyze or predict customer preferences and interests.
2. This function enables the Administrator to display advertisements tailored to the Customer’s preferences and interests, and to present products that best suit their needs. It also allows the use of appropriate communication methods, including the choice of communication language.
3. The data subject has the right not to be subject to a decision which is based solely on automated processing, including profiling, and which produces legal effects concerning them or significantly affects them.
6. RIGHTS OF THE DATA SUBJECT
1) In accordance with the GDPR, individuals who provide their personal data have the following rights:
- a) The right to be informed how personal data are processed,
- b) The right to access and update data,
- c) The right to withdraw consent — legal basis: Article 7(3) GDPR,
- d) The right to object to the processing of personal data — legal basis: Article 21 GDPR. The Customer has the right to object at any time, for reasons related to their particular situation, to the processing of their personal data, including profiling, if the Skórnik-Styl Online Store processes their data based on a legitimate interest,
- e) The right to delete data ("the right to be forgotten") — legal basis: Article 17 GDPR,
- f) The right to restrict data processing — legal basis: Article 18 GDPR,
- g) The right to data portability — legal basis: Article 20 GDPR,
- h) The right to lodge a complaint with a supervisory authority.
7. COOKIES
1) The Skórnik-Styl Online Store uses cookies. These are small text files sent by a web server and stored by the browser software. When the browser reconnects with the website, the site recognizes the type of device from which the user connects. The parameters allow the stored information to be read only by the server that created them. Cookies therefore make it easier to use websites previously visited.
2) The Administrator uses its own cookies to properly configure the Store, and in particular to:
- a) Adjust the content of the Store’s websites to the Customer’s preferences and optimize their use;
- b) Recognize the Customer’s device and location and display the website accordingly, tailored to individual needs;
- c) Remember the settings selected by the Customer and personalize the interface (e.g., language or region of origin);
- d) Match relevant advertisements according to the Customer’s preferences;
- e) Remember the history of visited pages to recommend relevant content;
- f) Manage font size, website appearance, etc.
8. FINAL PROVISIONS
1. The Administrator of the Online Store reserves the right to change this Privacy Policy at any time and place, while committing to immediately publish the new Privacy Policy on the Store’s website and inform all registered Users about it.
2. In matters not covered by this Privacy Policy, generally applicable provisions on the protection of personal data shall apply.
